BIDS A FINAL FAREWELL TO KOBE BRYANT, HIS WIDOW HAS FILED A WRONGFUL DEATH LAWSUIT, SHE SAYS THE OWNER OF THE HELICOPTER THAT CRASHED ON JANUARY 26 IS RESPONSIBLE FOR THE LOSS OF HER HUSBAND AND DAUGHTER. JUAN: A LEGAL EXPERT SAYS SHE MAY HAVE A STRONG CASE. JOY BENEDICT IS LIVE IN DOWNTOWN L.A. WITH THE DETAILS OF THE LAWSUIT. REPORTER: THE LAWSUIT ITSELF WAS FILED AT THE BEHIND ME EARLIER TODAY, THERE IS NO DOLLAR AMOUNT MENTIONED WHEN EXPERTS SAY IT COULD BE IN THE MILLIONS. IT WAS A HEART STOPPING SEEN ON THE CALABASAS HILLSIDE AND NOT A DAY DEDICATED TO GRIEVING THE LOSS OF KOBE BRYANT AND HIS DAUGHTER DG, VANESSA BRYANT MADE IT CLEAR LEGALLY THEY WILL NOT BE FORGOTTEN. HER ATTORNEY FILED A 72 PAGE LAWSUIT AGAINST ISLAND EXPRESS IN THE STATE OF ITS PILOT ARA ZOBAYAN. AN AVIATION ATTORNEY AND A FORMER N NAVAL PILOT, ALTHOUGH NOT WORKING DIRECTLY WITH THIS LAWSUIT, HE SAYS HIS ATTORNEYS WILL HAVE TO PROVE NEGLIGENCE TO WIN. IS PROBABLY NOT TOO DIFFICULT TO MAKE OUT THE CASE GIVEN THE INFORMATION THAT WE ALREADY HAVE. THE NTSB ALREADY RELEASED A DETAILED ACCOUNT OF THE CRASH MOVING THE INVESTIGATION AWAY FROM A MECHANICAL AIR AND TOWARD THE WEATHER AND ACTIONS OF THE PILOT. THERE'S A LOT OF GOOD RADAR INFORMATION, COMMUNICATION INFORMATION, UNFORTUNATELY A LOT OF INFORMATION FROM THE WRECKAGE SCENE AS WELL. IN THE 20 8 COUNT COMPLAINT, BRYANT'S ATTORNEYS MAKE NEGLIGENT CLAIMS AGAINST PILOT COMPANY CLAIMING THE PILOT WAS NEGLIGENT FOR FLYING ABOUT WHETHER IN THE COMPANY ALLOWED HIM TO OPERATE IN WHAT IT CALLS A RISKY MEANING OF TRANSPORT. CONSIDERING THE HELICOPTER DID NOT HAVE APPROPRIATE WARNING SYSTEMS FOR THE CIRCUMSTANCES. WAS THERE NEGLIGENCE EVOLVE? IT CERTAINLY SEEMS THAT WAY EARLY ON AND IS PRETTY CONSISTENT INFORMATION THAT THE PILOT INTO THE CLOUDS WHEN HE SHOULD NOT HAVE. AS PURSUING THE COMPANY AND NOT JUST THE PILOT WHO DIED IN THE CRASH, THEY SAY THE STANDARD BECAUSE IT WAS THE COMPANY'S JOB TO MAKE SURE THE HELICOPTER DID NOT CRASH. SELECTING THE PILOT TO MAKE SURE THEY FOLLOW THE PROCEDURES THAT THEY TRAIN THE PILOT PROPERLY. ISLAND EXPRESS DECLINED TO COMMENT ON THE CASE, THE WEBSITE AS A STATEMENT POSTED SAYING THEY ARE NOT FLYING, THEY SAY THEY LIKELY WILL NOT AGAIN. HE SAYS THIS WILL NOT BE THE ONLY LAWSUIT EITHER. WHATEVER INSURANCE MONEY THE COMPANY HAS IT WILL BE HANDED OUT TO THE VICTIMS OF THE CRASH FIGURING OUT WHICH VICTIM GETS WHAT WILL BE THE REAL FIGHT. EVEN IF THERE WAS $50 MILLION IN INSURANCE, THAT WOULD ARGUABLY IN ALL LIKELIHOOD NOT BE ENOUGH TO LEGALLY SATISFIED ALL THE PLAINTIFFS. EVEN THOUGH THIS PARTICULAR CLAIM ASKED FOR A JURY TRIAL, HE DOES NOT M THINK IT'LL MAKE IT THAT FAR, HE THINK SO BE SETTLED LONG BEFORE THAT, AND ISLAND EXPRESS WILL SHUTDOWN WHATEVER
